These Terms & Conditions ("Terms") govern your access to and use of the Kabootr website at kabootr.in, our mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About Kabootr
Kabootroperates a local delivery platform that connects customers with neighbourhood shops—including restaurants, pharmacies, and dairy counters—and independent delivery partners ("Riders"). We facilitate ordering, payment, and delivery coordination. Partner shops remain responsible for the products they sell, and Riders remain responsible for completing deliveries assigned through the platform.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under applicable law to use the Service. By using the Service, you represent that you meet these requirements. If you use the Service on behalf of a business, you confirm that you are authorised to bind that business to these Terms.
3. Account registration
Certain features may require you to create an account and provide accurate, current information such as your name, mobile number, and delivery address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at contact@kabootr.in if you suspect unauthorised access.
4. How ordering works
Through the Service, you may discover local shops, place orders (including by phone via the app), and request delivery to your location. Product availability, pricing, and fulfilment are determined by the partner shop unless we clearly state otherwise.
- Store prices: We aim to show prices charged by partner shops without platform markup. Final amounts may vary if items, quantities, or shop pricing change before confirmation.
- Delivery fees: Applicable delivery charges are shown before you confirm payment, where the feature is available.
- Order confirmation: An order is confirmed only after the shop accepts it and any required payment is successfully processed.
5. Payments and wallet
You may pay through payment methods supported in the app, including UPI and an in-app wallet where available. By submitting payment information, you authorise us and our payment partners to process charges for confirmed orders, applicable delivery fees, taxes, and any other disclosed amounts. Wallet balances, refunds, and top-ups are handled according to in-app disclosures and applicable law.
6. Cancellations, refunds, and issues
Cancellation and refund eligibility depends on order status, shop policy, and the nature of the issue (for example, incorrect items, non-delivery, or product quality concerns). Contact us at contact@kabootr.in or 8750-8000-99 for support. We may request reasonable evidence before issuing refunds or credits. Nothing in these Terms limits your statutory rights as a consumer under applicable Indian law.
7. Your responsibilities
You agree to:
- Provide accurate delivery details and remain reachable during fulfilment.
- Use the Service only for lawful purposes and in compliance with these Terms.
- Not misuse the platform, harass shop staff or Riders, submit fraudulent orders, or attempt to interfere with the Service's operation or security.
- Comply with applicable laws, including those relating to prescription medicines and age-restricted products where relevant.
8. Partner shops and Riders
Partner shops and Riders are independent third parties. Kabootr does not guarantee the quality, safety, legality, or suitability of products sold by shops, nor does it employ Riders as agents of the shops unless explicitly stated. Any product warranties or representations are primarily between you and the shop, subject to applicable consumer protection law.
9. Location and tracking
Where enabled, the Service may use location data to show nearby shops, estimate delivery times, and provide live order tracking. You can manage location permissions through your device settings, though some features may not work without them.
10. Intellectual property
The Service, including its software, branding, design, and content (excluding shop listings and user content), is owned by or licensed to Kabootr. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except as permitted by law or with our prior written consent.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant uninterrupted or error-free operation. Delivery times are estimates only. We are not responsible for events outside our reasonable control, including shop closures, traffic, weather, or telecommunications failures.
12. Limitation of liability
To the maximum extent permitted by applicable law, Kabootr and its affiliates, officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service. Our aggregate liability for claims relating to the Service shall not exceed the greater of (a) the amount you paid to us for the order giving rise to the claim in the three months before the event, or (b) INR 1,000, except where liability cannot be limited under applicable law.
13. Indemnity
You agree to indemnify and hold harmless Kabootr from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, breach of these Terms, or violation of any law or third-party rights.
14. Suspension and termination
We may suspend or terminate access to the Service if you breach these Terms, engage in fraud or abuse, or where required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.
15. Changes to the Service and Terms
We may update the Service or these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms, unless applicable law requires otherwise.
16. Governing law and disputes
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, subject to any mandatory consumer forum or arbitration requirements under applicable law.
